Penance Glyph = Toss

Well I realized some guy is using his penance glyph ( http://www.db.pandawow.me?item=45756/glyph-of-penance ) behind pillars, so that means Penance is as same thing as Toss, so can a guy be banned for that situation ?

 

-In short words, he casts one charge of Penance in front of pillar then the 2 charges behind pillar which allows him to avoid silence

it's not bannable when you start casting the spell if it's "channeled" like http://www.db.pandawow.me?spell=47540 + http://www.db.pandawow.me?item=45756 or http://www.db.pandawow.me?spell=103103 + http://www.db.pandawow.me?spell=137587 , http://www.db.pandawow.me?spell=120360
