I'll wait for GM's to Decline this. The bg is Strand of the Ancients he can be there before it starts, or was spawned there when he joined bg.

I've experienced the opposite scenario

 

one time when I was with my warlock deep back in our base (we were defending first) and i clicked on my Demonic Gateway just miliseconds before they won the round

then we swapped places but since I hadn't yet finished traveling to the other side of the gate I automatically flew back into the base were my gate was

 

I tried hiding (so I don't get banned) but it was too near the Alliance's spawn point and some of them saw me and tried to kill me (they weren't lucky but I went back to the beach as soon as I finished them)

hopefully noone reported me that time
